- Establishment of criteria for screening abuse of market dominance in the online platform sector -

The Fair Trade Commission (Chairman Han Ki-jung) has established guidelines for reviewing online platform operators' abuse of market-dominant status and will take effect from January 12.

The screening guidelines do not create new regulations, but specify the criteria for monopoly abuse stipulated in the current Fair Trade Act based on law enforcement cases in the online platform sector accumulated so far,

It was prepared through a public-private joint organization meeting (10th in total), expert research services, industry meetings, and consultations with related ministries.

This review guideline does not establish new regulations in the online platform sector, but rather provides necessary considerations for determining whether market-dominant status abuse is applicable under the current Fair Trade Act based on accumulated law enforcement cases.

The current law enforcement standards stipulated around traditional industries have been supplemented to sufficiently reflect the characteristics of the online platform sector and examine competition restrictions.

In addition to concerns about competition restrictions such as the tipping effect in the online platform sector, pro-competitive effects such as enhancing consumer benefits and promoting innovation were also reflected in a balanced manner.

It is expected to increase the predictability of law enforcement by presenting market definition and market power evaluation criteria considering the characteristics of the online platform sector, while contributing to prevent violations of the law by exemplifying representative types of actions that are feared to limit competition through specific examples
